The petitioner is wife of late Anjani Sinha, Special Assistant, Branch Office, Punjab National Bank, Nawada Govind Ganj, who died in harness.
Mr. Ajeet Kumar, learned counsel for the petitioner very fairly submits that though the ex-gratia amount has been paid, but the interest on delayed payment on the same has not been paid by the respondent Bank. The petitioner in support of her claim for payment of interest on delayed payment has relied upon Division
Patna High Court CWJC No.4248 of 2014 dt.17-05-2016 2/2 bench decision of this Court in case of Ram Sumer Ahair Vs. The Union of India & Others, reported in 2004 (1) PLJR 158, which in turn relied upon the decision of the Hon'ble Apex Court in case of State of Kerala & others Vs. M. Padmanabhan Nair, reported in (1985) 1 SCC 429.
If the petitioner files a representation before the respondent no.2 with respect to claim of the interest on delayed payment of ex-gratia amount, he will dispose of her application by a speaking order preferably within a period of two months from the date of receipt of a copy of this order.
The writ application stands disposed of.
