JUSTICE SANJAY PRIYA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajepur P.S. Case No. 07 of 2017 instituted for the offence under Sections-302, 201/120B of the Indian Penal Code.
It has been submitted on behalf of the petitioner that his name has been given in the written report merely on suspicion. The cause of death as per postmortem report is asphyxia. In the written report, it is alleged that son of the informant has illicit relation with daughter of the petitioner and therefore, this petitioner with other accused persons committed murder of his son.
In such manner, in the written report, mere suspicion has been raised against the petitioner. The postmortem report
Patna High Court Cr.Misc. No.21160 of 2017 (3) dt.23-06-2017 2/2 reveals the cause of death as asphyxia.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rajepur P.S. Case No. 07 of 2017 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar at Motihari, East Champaran subject to condition that both the bailors should be close relatives of the petitioner.
