This application for regular bail arises out of Brahmpur (Krishnabrahm) P.S. Case No. 533 of 2019, disclosing the offences under Sections 399, 412 of the Indian Penal Code, Sections 25(1-b) a, 26 and 35 of the Arms Act. Learned counsel appearing on behalf of the petitioner referring to the First Information Report has submitted that though, there is allegation against all the persons named in the First Information Report of having assembled to commit dacoity, from the petitioner's possession, only one live cartridge was allegedly recovered. Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Brahmpur (Krishnabrahm) P.S. Case No. 533 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
