JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-08-2019 The present writ petition has been filed for directing the respondent Housing Board to get the agreement executed pertaining to the plot allotted to the petitioner herein i.e. Plot No. M.P.-74 admeasuring an area of 1650 sq. ft. situated at village-Ashikpur, Sasaram which was allotted vide order no. 2905 dated 27.11.2002.

Without going into the history of the present case, it would be suffice to state that since the petitioner is ready to pay the current M.V.R. of the plot in question, as per the rate of the financial year 2019-20, I deem it fit and proper to relegate the

Patna High Court CWJC No.4243 of 2014(5) dt.23-08-2019 2/2 petitioner to the remedy of approaching the Chairman, Bihar State Housing Board and in case the petitioner files an appropriate representation, the Chairman, Bihar State Housing Board shall consider the same positively and in case it is decided to grant the plot in question on the current M.V.R. value of the year 2019-20, the amount already deposited by the petitioner shall be adjusted.

It goes without saying that the final decision shall be taken by the Chairman, Bihar State Housing Board within a period of two months of receipt of a representation from the petitioner herein, in accordance with law.

The writ petition stands disposed off on the afoaresaid terms.
