The petitioner seeks bail in Ziradei P.S. Case No. 51 of 2016 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and under Sections 25(1-b)a, 26/35 of the Arms Act.

The informant got information that some criminals had assembled on the bank of Sona river. The place was raided and the petitioner Vijay Tiwari @ Vijay Kumar Tiwari, Samish Kumar @ Chhote, Ramesh Kumar and others were apprehended. They disclosed the name of other accused persons who managed to flee away.

Learned counsel for the petitioner submits that from possession of the petitioner one loaded country made pistol and

Patna High Court Cr.Misc. No.22340 of 2017 (2) dt.19-05-2017 2/2 live cartridges were recovered. The petitioner is in jail since 10.11.2016. The petitioner has already remained in jail for more than six months and he has got one criminal case registered under Sections 20/22 of the NDPS Act.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Siwan in Ziradei P.S.
