Case No.19 of 2013, registered for the offences punishable under Sections- 147, 148, 149, 447, 323, 302, 379, 504 and 506 of I.P.C. and Section-27 of the Arms Act.
Apprehending arrest, the petitioner filed A.B.P. No.1121 of 2013, in the court of learned District and Sessions Judge, Patna. The learned Judge rejected the application through order dated 26.4.2013. Hence, this application for grant of anticipatory bail under Section-438 of Cr.P.C.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The allegation in the F.I.R. is, no doubt, serious in nature. The fact, however, remains that no
Patna High Court Cr.Misc. No.23729 of 2013 (3) dt.01-04-2015 2/2 severe acts were attributed to the petitioner, nor he was found present on the scene of occurrence. Further, this Court granted bail to other accused in Cr. Misc. No.22924/13. Therefore, the application is allowed. In the event of arrest, the petitioner is directed to be released on bail upon furnishing the bailbond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of A.C.J.M., Danapur, in connection with Maner P.S. Case No.19 of 2013, subject to the conditions laid down under Section-438(2) of Cr.P.C.
