The petitioner, who was one of the applicants for being appointed as Anganwari Sewika in the concerned Anganwari Centre, is aggrieved by the fact that despite her complaint with respect to the illegal appointment of privaterespondent no. 7 on the post, no decision has yet been taken by the District Programme Officer, Madhubani.
Patna High Court CWJC No.4118 of 2019 dt.06-03-2019 2/3 It has been submitted on behalf of the petitioner that the private-respondent no. 7, who has been appointed on the post of Anganwari Sewika does not hail from the concerned area, which should have been the main consideration before appointing her on the post of Anganwari Sewika. On the complaint made by the petitioner before the District Programme Officer, Madhubani, a direction has been given to the C.D.P.O., ICDS to hold an enquiry and submit report, before the complaint of the petitioner is disposed off. Despite passage of a long time, neither the C.D.P.O., ICDS has submitted any report after enquiry nor the proceeding has been concluded by the District Programme Officer, Madhubani.
Under the aforesaid circumstances, this Court directs the petitioner to make a fresh representation before the District Programme Officer, Madhubani, which will serve as a reminder to him that the proceedings which have been initiated be concluded at the earliest, preferably within a period of three months from today. The District Programme Officer, Madhubani is further directed to ask for the enquiry report from the concerned C.D.P.O.

The District Programme Officer, Madhubani, on receipt of such representation / reminder, commence with the proceedings and after perusal of all the reports, and after hearing the petitioner, the private-respondent no. 7 and other stake-holders, shall conclude the proceeding and pass a reasoned order within a period of three months as indicted above. Should the petitioner remain dissatisfied even then, it would be open for her to approach the District Magistrate, Madhubani for necessary orders.
With the aforesaid observation / direction, this petition stands disposed off.
