JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 337 of 2014 registered under sections 302/34 of the Indian Penal Code. Admittedly, none has seen the actual killing of the deceased nor the petitioner had gone to the house of the deceased and the name of the petitioner is said to have come in the statement of other accused who took the deceased taking the name of the petitioner. The petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this

Patna High Court Cr.Misc. No.13330 of 2015 (3) dt.29-06-2015 anticipatory bail petition is allowed and it is ordered that the petitioner, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 337 of 2014 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
