JUSTICE SANDEEP KUMAR ORAL ORDER 13-01-2022 Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioner and Mr. Jharkhandi Upadhyay, learned counsel for the State through video conferencing.

The petitioner seeks anticipatory bail in connection with Complaint Case No. C-899/2011 registered for the offences under sections 406, 420 and 120B of the Indian Penal Code. The counter affidavit filed on behalf of the State is considered by this Court.

Learned counsel for the petitioner Shri Bimlesh Kumar Pandey, on instruction, says that the petitioner is ready to pay the entire amount of Rs.1,20,000/- (Rupees One lacs twenty thousand) by way of demand draft to the complainant within a

Patna High Court CR. MISC. No.22414 of 2021(3) dt.13-01-2022 2/2 period of two months from today.

In such view of the matter, if the entire amount is deposited by the petitioner in the court below by way of demand draft issued in favour of the complainant within a period of two months from today, the same shall be handed over to the complainant. On deposit of the entire amount and on receipt of the same by the complainant, the Complaint Case No. 899C/2011 pending in the Court of learned A.C.J.M. 4th, Bettiah, West Champaran shall stand quashed.

The stay of arrest granted in favour of the petitioner by order dated 23.12.2021 shall continue for the next two months to facilitate him to give the entire amount to the complainant.
