This is a petition for grant of regular bail for offence under Sections 302, 201, 34 and 120B of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner and other co-accused is of firing causing death of Ram Balak Darhi. Submission of the learned counsel for the petitioner is that similarly situated co-accused, Ram Gulam Darhi, and some other co-accused have already been allowed regular bail by this Court vide order, dated 06.10.2015, passed in Cr. Misc. No. 36207 of 2015 and other referred criminal miscellaneous petitions. Further, submission is that charge sheet has already been submitted and there is no allegation of tampering with the evidence against the petitioner. More over, the petitioner undertakes to fully cooperate with the further proceeding of the case.

No.20625 of 2017 (3) dt.22-06-2017 2/2 Considering the entire facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Sessions Trial No. 784 of 2010 arising out of Sarmera P.S. Case No. 34 of 2002 to the satisfaction of the Additional District Judge, III, Nalanda at Biharsharif, or successor Court.
