The petitioner seeks regular bail in connection with Simari P.S. Case No. 273 of 2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of huge quantity of illicit liquor from a Bazra field situated at village Dulahpur. The learned counsel for the petitioner submits that neither the Bazra field belongs to the petitioner nor recovery has been made from possession of the petitioner and the petitioner is having a clean antecedent and is languishing in custody since 16.01.2019. It is further submitted that the co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 11.02.2019 passed in Cr. Misc. No. 7816

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-II cum Special Judge, Excise Act, Buxar in connection with Simari P.S. Case No. 273 of 2018.
