2. The petitioner is seeking regular bail in connection with Kotwa P.S. Case No. 55 of 2023 for the offence registered under Sections 304B 201 and 201/34 of the Indian Penal Code.
3. As per the allegation, marriage of the deceased was solemnized with the petitioner on 06.06.2017. After marriage, the petitioner and his family members tortured the victim for non-fulfillment of dowry demand of Apatche motorcycle and Rs. 1,00,000/-. After birth of two baby girls, the atrocities inflicted at the hands of the petitioner and his family members were intensified and the accused persons demanded the expenses occurred on these two baby children. On 15.02.2023,
Patna High Court CR. MISC. No.15246 of 2024(5) dt.23-08-2024 2/3 the informant received a telephonic information that the accused persons committed murder of the deceased by pressing her throat and they were burnt the dead body. The informant went there and saw the accused persons burning the dead body of the deceased. The police was called on Toll Free No. 112 and when the police reached there and recovered the semi burnt dead body. The police also made a videography of recovery of the semi burnt dead body.
4. Learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated. His submission is that the informant and his family members were demanding Rs. 5,00,000/- as well as the custody of these two baby children which was denied by the petitioner and the family members due to which they have been implicated in false case.
5. As per the FIR, soon before the death of the deceased, a demand of Apatche motorcycle and Rs. 1,00,000/- was made by the petitioner and his family members. At the instance of the informant, the semi burnt dead body of the deceased was recovered when the accused persons were trying to burnt it.
6. In my view, this is not a fit case for grant of bail
Patna High Court CR. MISC. No.15246 of 2024(5) dt.23-08-2024 3/3 which is accordingly rejected.
7. However, the learned Trial Court shall take every endeavour to expedite the trial.
