JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barun P.S. Case No. 97 of 2018 for the offence under Sections 395, 436, 504, 120B and other allied Sections of the Indian Penal Code and Section 3/4 of the Prevention of Damage of Public Property Act.
Allegation against this petitioner is that he was among the mob, who created disturbance and obstructed the movement of N.H.
Learned counsel for the petitioner submits that in the instant case 86 named persons and 200 unknown persons were made accused. Learned counsel submits that the petitioner has got no criminal antecedent and he is in custody since 06.01.2019. He further submits that similarly circumstanced

Considering the fact that the petitioner was not named in the F.I.R. and similarly circumstanced others have been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
