Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22 and 24 of the Narcotic Drugs & Psychotropic Substances Act, 1985. Allegation is that from arrested persons different small quantity of brown sugar was seized including from possession of the petitioner.

Submission is that the police has already submitted charge-sheet and the seized contraband was never sent for forensic examination to ascertain whether it was really brown sugar or not. Petitioner has got no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

No.11153 of 2019(3) dt.06-05-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 124 of 2018 arising out of Patrakar Nagar Police Station Case No. 593 of 2018, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Let the Senior Superintendent of Police, Patna inform this Court regarding action taken report against Investigation Officer of Patrakar Nagar Police Station Case No. 593 of 2018 for inaction in not sending the seized contraband for forensic examination.

The report of the Senior Superintendent of Police must come within six weeks from receipt/production of a copy of this order.

Let a copy of this order be sent to the Senior Superintendent of Police.
