JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273/308/420 of the Indian Penal Code and Section 47(a) of the Bihar Prohibition and Excise Act, 2016.
150 liters of country-made liquor was allegedly recovered from the possession of the co-accused. Allegation is that the petitioner fled away from there.
Submission is that the said co-accused Raju Singh has already been allowed bail vide Annexure-3. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.20639 of 2017 (2) dt.03-05-2017 2/2 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan/Successor Court, in connection with Darauli P.S. Case No.120 of 2016, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
