The petitioner is apprehending his arrest in connection with Darbhanga Complaint Case No.C.R.No.890 of 2016 , registered for offences punishable under Section 498(A) of the Indian Penal Code.

The petitioner happens to be husband and there is allegation of demand of Rs.05 lac and for that subjecting the O.P.no.2 for cruelty and also ousted her from the house. Submission of the learned counsel for the petitioner is that he has also lodged a case against the complainant for misbehaving and assaulting the family members of the petitioner. It has also been submitted that the petitioner has also

Patna High Court CR. MISC. No.1938 of 2019(4) dt.27-03-2019 2/2 filed a divorce case and thereafter the present case has been filed.

In this case a notice was also issued to O.P.no.2 but in spite of receiving the notice, no one has appeared even on last date and today also neither the O.P.no.2 becomes present nor anybody appears on behalf of O.P.No.2.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Darbhanga in connection with C.R. Case No.890 of 2016 corresponding to Trial No.1657 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
