The petitioner seeks regular bail in connection with Kesaria P.S.Case no.466 of 2018, registered for offences punishable under Sections 363, 365, 366A of the Indian Penal Code.

Prosecution story of kidnapping of the minor victim girl of the informant by the petitioner.

Submission of the learned counsel for the petitioner is that though in her statement recorded under Seciton 164 Cr.P.C. she has stated about kidnapping by the petitioner but earlier actually she was recovered from the Bus Stand by the police, which will ape par from para 19 of the case diary and in para 4 of the case diary she has stated that she has made

Patna High Court CR. MISC. No.13295 of 2019(5) dt.20-05-2019 2/2 allegation on the information supplied by one Gautam Devi wife of Hagen Singh with whom the petitioner has civil dispute and the title suit is going in . The petitioner is in custody since 31.10.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Motihari in connection with Kesaria P.S.Case No.466 of 2018.
