JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-09-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Ghoghardiha Police Station Case No. 136/2020/ Sessions Trial No. 123/2020 registered for the offences punishable under sections 458, 302 and 382 of the Indian Penal Code.

As per the prosecution case, informant got information from his villagers that his mother who was living alone in the village has been killed while committing theft in the house by the unknown accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Informant is not the eye witness. There is no substantive evidence to suggest the implication of this petitioner in the present case. Petitioner has got clean

Learned counsel for the State opposes the prayer for bail and submits that on the disclosure made by the petitioner, looted materials have been recovered during course of investigation.
