JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Panchayat Mukhiya is apprehending arrest in a case registered for the offences punishable under Sections 408, 409, 420 and 120B/34 of the Indian Penal Code.
The accusation is of purchasing solar lights under 4th and 13th finance commercial scheme from agency other than BREDA or BELTRON. The total misappropriation alleged is `18, 05,904/-.
It is submitted by learned counsel for the petitioner that there was no such direction for purchase of solar lights from BREDA or BELTRON. The FIR has been lodged with inordinate delay and Certificate Case Nos. 71 of 2013-14 and 72 of 2014-15 have already been lodged against the petitioner.

No.15847 of 2015 (2) dt.17-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Arrah in connection with Ayar P.S. Case No. 92 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
