The petitioner seeks bail in Barauni P.S. Case No. 30 of 2017 registered under Section 188 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The police intercepted a truck but the petitioner and the person who was sitting on the truck began to flee away. On chase, Sanjeev and Govind were apprehended. Sanjeev, the driver of the truck, stated that the petitioner and others are involved in transportation and sale of wine.

Learned counsel for the petitioner submits that the driver of the truck was carrying vegetables but liquor was also found. Save and except disclosure made by the driver, the house of the petitioner was not searched and nothing has been recovered

Patna High Court Cr.Misc. No.21093 of 2017 (2) dt.04-05-2017 2/2 from the possession of the petitioner. The petitioner is in custody since 23.02.2017.

Considering the facts aforesaid and the fact that the petitioner has remained in jail for more than two months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 30 of 2017.
