JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 This is an application for grant of anticipatory bail in connection with G.O Case No. 758 of 2018 arising out of Bahadurpur P.S. Case No. 383 of 2018, disclosing offences under Sections 30(a), 41(i) of the Bihar Prohibition and Excise Act 2016.
Allegation is of recovery of 96 bottles liquor each containing 375 ml from the field of Bishwnath Jha and petitioner is also named in the F.I.R. Further it appears that petitioner is accused in two other cases.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his conscious possession. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.1786 of 2019(3) dt.23-01-2019 2/2 Having heard both sides, considering the above facts and circumstances of the case and criminal antecedents of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
