The petitioner is languishing in custody for the offence punishable under Section 395 of the Indian Penal Code. Name of the petitioner surfaced in the confessional statement of co-accused. The FIR of the occurrence of dacoity is against unknown. Petitioner in custody since 05.11.2018. Submission is that investigation of the case is already complete and petitioner was never put on TIP nor any incriminating article has been recovered from the possession of the petitioner. Some other co-accused has been allowed bail by other co-ordinate Bench of this Court.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.12174 of 2019(2) dt.25-04-2019 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bihiya P.S. Case No. 252 of 2018, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
