2. The accused/petitioner is named in F.I.R. and apprehending her arrest in connection with Patepur P.S. Case No. 18/2023 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.
3. The allegation against petitioner is to kidnap the minor daughter of informant along with co-accused persons/family members for the purpose of illicit intercourse/marriage.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No. 15177 of 2024(2) dt.14-03-2024 2/3 petitioner submitted that name of petitioner implicated with the present case only being the mother of main co-accused Ranveer Kumar with whom the daughter of informant was in love affairs. It is submitted that after recovery, the statement of daughter of informant was recorded under Section 164 of Code of Criminal Procedure (Cr.P.C.), where she categorically stated that out of her own sweet will, she left her house and thereafter solemnized marriage with the son of petitioner and living separately as a couple.
5. Learned APP appearing for the State opposes the prayer of bail.
6. Considering the aforesaid facts and circumstances and by taking note of fact as implication of petitioner prima facie appears being mother of main coaccused Ranveer Kumar, who is a lady of clean antecedent, accordingly, the above named petitioner, in the event of her arrest or surrender before learned trial court within a period of four weeks, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No. 15177 of 2024(2) dt.14-03-2024 3/3 learned J.M.-1st Class, Vaishali at Hajipur/concerned Court, where the case is pending in connection with Patepur P.S. Case No. 18 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
