JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 143, 341, 342, 447, 323, 307, 379, 427, 504 of the Indian Penal and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is general allegation that the accused persons variously armed assaulted the informant. He further submits that out of 19 persons named in the First Information Report, charge sheet was submitted only against 14 persons. He further submits that no one was injured and the allegation against the petitioner stood unverified. He submits that co-accused Chandra Mani Singh, against whom also the allegation is not verified, has been granted anticipatory bail by order dated 11.2.2015 passed in Criminal Misc. No.36613

Having considered the facts and circumstances of the case, the petitioner Chhabila Singh is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bonds of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Shri Ajay Kumar, Judicial Magistrate 1st Class, Biraul at Benipur in the district of Darbhanga in Kusheshwar Asthan P.S. Case No.118 of 1999.
