====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor for the State.

The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 341, 323, 308, 448, 427, 504 of the Indian Penal Code. On the alleged date and time of occurrence, all the F.I.R. named accused persons including this petitioner armed with various weapons broke the bamboo door of the informant, damaged the motorcar and assaulted the father of the informant with iron rod. It is further alleged that this petitioner assaulted with axe on the head of Murtaza.

It is submitted that due to land dispute, this petitioner has been falsely implicated in this case. Injury allegedly caused by this petitioner has been found simple by Doctor.

Patna High Court CR. MISC. No.14161 of 2023(3) dt.26-06-2023 2/2 However, learned A.P.P. for the State opposes the bail petition and submits that there is specific allegation of assault against this petitioner and petitioner has got three criminal antecedents.

Considering the nature of accusation and criminal antecedent, the prayer for anticipatory bail of petitioner is rejected.
