JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 364A, 379/34 of the I.P.C. The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application with an observation "at this stage".

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.4.2016. Charge has already been framed. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The victim has not named the petitioner in his statement recorded under Section 164 Cr.P.C.

On behalf of the State, it is submitted that the

Patna High Court Cr.Misc. No.21282 of 2017 (3) dt.12-07-2017 2/2 petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VIth, Motihari, East Champaran in connection with S.Tr. No.525 of 2016 arising out of Paharpur P.S. case No.73 of 1997. (Sudhir Singh, J) Narendra/- U T
