NATH ORAL JUDGMENT 28-04-2015 Heard the learned counsel for the petitioner. The learned counsel for the State-respondents is also present. It has been submitted by the learned counsel for the petitioner that by order dated 14.11.2014 (Annexure-3) the executing court has given liberty to the petitioner to file objection petition on the next date. It has been further pointed out that on the next date i.e. 26.11.2014, the objection petition has been filed. However, it is the contention of the learned counsel for the petitioner that the learned court below has not disposed of the said objection petition and is proceeding with the execution proceeding without considering the objection petition.

Patna High Court CWJC No.3719 of 2015 (2) dt.28-04-2015 In this backdrop, the learned counsel for the petitioner has confined his prayer in this writ application for a direction to the learned court below to dispose of the objection petition filed by the petitioner on 26.11.2014.

Without going into the merits of the case of the petitioner, this writ application is disposed of with a direction to the learned court below to dispose of the objection petition said to have been filed by the petitioner on 26.11.2014 before passing any final order concluding the proceeding.

The writ application is accordingly, disposed of with the aforesaid direction.
