Petitioner apprehends arrest in connection with Sasaram Excise P.S. Case No. 91 of 2022 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from paddy straw behind the house of the petitioner, which is an open place, as is evident from the seizure list. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent.

Case No. 91 of 2022/ Excise Case No. 135 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
