Perused the impugned order dated 17.08.2016 passed by Additional Munsif-IV, Gaya in Title Suit No.158 of 1999/Trial No.09 of 2016.

From perusal of the impugned order, it appears that earlier application was filed by the petitioner for producing the documents in the year 2003. The court below rejected the application recording finding that documenters are irrelevant documents for the purpose of deciding the case and, therefore, the documents were withdrawn by the present petitioner. At the time of argument of title suit again the same documents were sought to be produced by the defendant-petitioner. The learned counsel at the time of hearing of this civil miscellaneous application submitted that the case has been fixed for judgment after conclusion of hearing.

Patna High Court C.Misc. No.1049 of 2016 (2) dt.10-11-2016 In view of the above facts and circumstances of the case, in my opinion, no case for interference in exercise of supervisory jurisdiction is made out. Accordingly, this civil miscellaneous application is dismissed.
