JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mahila Thana Bhojpur P.S. Case No.327 of 2016 registered for offences punishable under Sections 376/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. As per the prosecution case, co-accused Sandesh Kumar has been sexually harassed the informant on the pretext of marriage and the present petitioner is brother in law of the coaccused Sandesh Kumar. Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. There is Specific allegation is against co-accused Sandesh Kuamr and general and omnibus allegation levelled against the petitioner. It

Considering the fact that there is no specific overt act has been attributed against the petitioner as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhojpur, Ara in Mahila Thana Bhojpur P.S. Case No. 327 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
