JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2016 Heard the parties. At the very outset, it is pointed out that petitioner no. 1, namely, Gorango Das, has already been arrested and, therefore, his prayer for anticipatory bail has become infructuous. So far as petitioner no. 2, namely, Posiya Devi, and petitioner no. 3, namely, Sirpan Devi, are concerned, they are ladies and it is alleged that petitioner no. 2 gave single lathi blow causing head injury to informant's husband but the impugned order goes to show that the informant's husband sustained simple injury. Accordingly, this application in respect of petitioner no. 1, namely, Gorango Das, is dismissed as having become infructuous.
Patna High Court Cr.Misc. No.45061 of 2016 (2) dt.16-12-2016 2/2 So far as petitioner no. 2, namely, Posiya Devi, and petitioner no. 3, namely, Sirpan Devi, are concerned, it is ordered that they, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Katihar in Azamnagar Police Station Case no. 214 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
