JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 458 of 2017, dated 03.08.2017, instituted for the offences under Section 30(a) of the Prohibition and Excise Act, 2016.

Approximately 267 litres of liquor is said to have been recovered from a vehicle which was occupied by two persons, viz., Pramod Kumar and Avinash Kumar. The aforesaid two persons, on being arrested, had taken the

The learned counsel for the petitioner has submitted that there is no recovery either from the possession or constructive possession of the petitioner. Apart from this, the petitioner enjoys clean antecedent.

Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 458 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
