JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner seeks bail in connection with Special Case No. 21 of 2020 arising out of Raniganj P.S. Case No. 01 of 2020, dated 01.01.2020, instituted for the offences under Sections 30(a) and 37(b) and (c) of the Bihar Prohibition and Excise Act.

The petitioner is in custody since 02.01.2020 and does not have criminal antecedents.

From the accusation made in the F.I.R., it appears

Patna High Court CR. MISC. No.11308 of 2020(2) dt.29-02-2020 2/2 that the petitioner along with others was found to be drunk. There is recovery of 50 litres of locally brewed liquor and the raw materials for preparation of such liquor from the house of the petitioner.

Learned counsel for the petitioner submits that he has falsely been implicated in this case. The house in question is not a pucca house and also not in exclusive possession of the petitioner.

Considering the fact that the petitioner has clean antecedents and is in custody since 02.01.2020, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-Cum-Special Judge, Araria in connection with Special Case No. 21 of 2020 arising out of Raniganj P.S. Case No. 01 of 2020.

The application stands allowed.
