JUSTICE RAKESH KUMAR ORAL ORDER 28-11-2016 Heard Sri Shardanand Mishra, learned counsel for the petitioner and learned Additional Public Prosecutor . The petitioner in the present case has made a prayer for a peculiar relief. He has come as if his petition filed under Section 239 of the Cr.P.C. for discharge was rejected. However after going through the impugned order i.e. order dated 22.1.2013 it is evident that charge matter was heard by the trial court on 4.12.2012 and there was reasoned order. Subsequently again a petition for discharge was filed . Normally such petition was not

Patna High Court Cr.Misc. No.22938 of 2013 (3) dt.28-11-2016 2/2 required to be entertained.

I do not find any ground to interfere with the impugned order.

The petition stands dismissed.
