Petitioner seeks bail in a case registered under Section 341, 147, 148, 149, 324, 302, 201 of Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case on the basis of suspicion.
From the case diary, it appears that the petitioner's Gamcha has been recovered from the Khanda from where the body of the deceased has been recovered and in the first information report, it has been stated that the petitioner, along with 10-12 persons, were seen in the locality prior to the occurrence. Recovery of the Gamcha distinguishes the case of the petitioner
Patna High Court Cr.Misc. No.12391 of 2018 (3) dt.05-04-2018 2/2 from Ram Bachan Yadav, who is a co-accused and who has been allowed bail by this Court in Cr Misc No 2459 of 2018.
