Petitioner apprehends arrest in connection with Ballia P.S. Case No. 274 of 2020 registered for the offence punishable under sections 279, 427, 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because he is owner of the vehicle in question. As a matter of fact, the alleged vehicle was being used for commercial purpose as cab, as is evident from Anenxure-A to the supplementary affidavit. Apart from that, the driver of

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise Act, Begusarai in connection with Ballia P.S. Case No. 274 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
