JUSTICE MADHURESH PRASAD ORAL ORDER 26-06-2023 Learned counsel for the petitioner submits that petitioner has been serving as a 'Bio Chemist' in the respondent-IGIMS since 2006, but has not been granted any promotion. He is confining his relief in the instant writ application to his claim for promotion in recognition of his service since the year 2006, for which he has made his application before respondent No. 3, copy of which is Annexure- P/10 to the writ application. Learned counsel for the respondent- IGIMS is not present.
In view of nature of subsisting relief, as per submission of the learned counsel for the petitioner and since the petitioner's claim for promotion is to be considered by the
Patna High Court CWJC No.3215 of 2019(3) dt.26-06-2023 2/2 respondent No. 3, pendency of the instant writ proceedings would serve no useful purpose, as no adjudication is called for. Accordingly, the writ application is disposed of with direction to respondent No. 3 to consider the petitioner's claim and dispose it of by a reasoned and speaking order in accordance with law within three (3) months from the date of receipt/production of a copy of this order.
