This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 456, 354(B) and 306 of the Indian Penal Code, registered in connection with Mednichowki P.S.Case No. 94 of 2022 (S.T.No.274 of 2022) As per allegation, the petitioner entered into the house of the informant when his daughter was sleeping. The petitioner was apprehended and handed over to the police. The daughter of the informant attempted to commit suicide due to the act of the petitioner.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.12139 of 2023(2) dt.24-03-2023 2/2 that the victim did not make any allegation against the petitioner and in her statement under Section 164 of the Cr.P.C. she has stated that she herself called the petitioner in her house. The petitioner is in custody since 14.07.2022.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Lakhisarai in connection with Mednichowki P.S.Case No. 94 of 2022, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
