Petitioner is seeking anticipatory bail in connection with Korha P.S. Case No. 418 of 2018 registered for the offences punishable under Sections 419/ 420/406/34 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR, his name has transpired in the confessional statement of co-accused Suraj Kumar. It is further submitted that nothing has been recovered from the house of the petitioner. In paragraph 9 of the application, it is stated that the petitioner is intermediate passed and is preparing for competitive examinations. It is further stated that the petitioner has no criminal antecedent and his name has been involved in this case because of the enmity with another co-

Learned APP for the State is present and has opposed the prayer for bail.

In the given facts and circumstances of the case considering that the petitioner is said to be a student and has no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 418 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
