JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2017 The petitioner is in custody since 12.03.2017 in connection with Kutumba P.S. Case No. 34 of 2017, registered for offences punishable under Sections 414 of Indian Penal Code. It has been submitted on behalf of the petitioner that it is alleged that a motorcycle was recovered by the police about which, one Niraj Kumar told the police that the same belong to the petitioner, however, it is submitted that the said motorcycle has been purchased by the petitioner from one Birju Rajwar and the petitioner had no knowledge about the said motorcycle being stolen one as other also had purchased the motorcycle from the said Birju Rajwar. Petitioner has no criminal antecedent and has been in judicial custody since 12.03.2017 and other co-accused person having similar allegation has already been granted bail by

Patna High Court Cr.Misc. No.20738 of 2017 (2) dt.09-05-2017 2/3 this Court vide order dated 01.05.2017 passed in Criminal Miscellaneous No. 19471 of 2017.

Heard learned A.P.P. also.

Having heard both sides, considering the aforementioned facts and circumstances of the case, nature of offence and the period of custody and also that the petitioner has no criminal antecedent and other co-accused having similar allegation has already been granted bail by this Court, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Aurangabad, in connection with Kutumba P.S. Case No. 34 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates
