JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a compliant case wherein process was directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 406 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfilment of the dowry demand.

The matter was referred to the Mediation Centre of the Bihar State Legal Services Authority vide order dated 30.04.2015. The report of Mediator at flag-„A‟ dated 03.08.2015 suggests that in spite of best and sincere efforts the dispute between the parties could not be resolved through the process of mediation. The matter was heard on 4th of August, 2015 when the

Patna High Court Cr.Misc. No.12767 of 2015 (4) dt.05-08-2015 2/3 petitioner expressed his willingness in presence of the complainant to keep her as wife with full dignity and honour. Though, statement to that effect has also been made in paragraph no. 13 of the petition which reads as follows:- "That the petitioner is ready to keep his wife with full honour and dignity."

On prayer of the learned counsel for the complainant, the matter was passed over on 04.08.2015. Today the petitioner is present but the complainant is not present, however, learned counsel for the complainant submits that due to past conduct of the petitioner the complainant is not ready to accept the offer of the petitioner.

The marriage between the petitioner and the complainant having no issue and both being employed as Engineer are not in dispute.

Considering the stand of the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.DJ.M., Patna City in connection with Complaint Case No. 155C of 2013, subject to the conditions as

Patna High Court Cr.Misc. No.12767 of 2015 (4) dt.05-08-2015 3/3 laid down under Section 438(2) Cr.P.C.

The present order will not preclude the parties to resolve the issue otherwise.
