18-03-2016 Heard learned counsel for petitioners and learned Addl. Public Prosecutor.
Two petitioners, invoking inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, have prayed for quashing of an order dated 30-10-2012 passed by learned Additional Chief Judicial Magistrate, Danapur in Maner P.S. Case No. 153 of 2011. By the said order, the learned Magistrate has taken cognizance of offence under Sections 304(B)/34 of the Indian Penal Code after submission of the chargesheet against the petitioners, who are none else but motherin-law and father-in-law of the deceased. Learned counsel for petitioners, by way of referring to
Patna High Court Cr.Misc. No.23629 of 2013 (3) dt.18-03-2016 2/2 F.I.R., tried to persuade the Court that it is a false case. It is a case of death of daughter of informant, which had occurred in the house of the petitioners within a period of two years from the date of marriage.
I do not find any defect in the order of cognizance. The petition stands dismissed.
