Petitioner, already in custody, seeks bail in connection with Phulparas P.S. Case No.195 of 2016, registered under Sections 147, 148, 149, 341, 323, 326, 307 and 302 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that due to land dispute, Sukh Sagar Yadav shot at son of the informant followed by firearm shot given by Lochan Yadav, Pramod Yadav, Hari Yadav and Chandan Yadav.

Learned counsel for the petitioner submits that there is land dispute between both sides and there is no allegation of opening fire by the petitioner on the deceased; the allegation of firing is against other accused persons and the petitioner has no criminal

Having considered the said facts and circumstances, petitioner Surendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Jhanjharpur, District Madhubani in connection with Phulparas P.S. Case No.195 of 2016.
