Petitioner seeks bail in connection with Laxmipur P.S. Case No. 21 of 2015 registered under Sections- 364A and 458/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the first information report. Petitioner's name has come on the confessional statement of the co-accused. Petitioner has not been put on Test Identification Parade. Similarly situated co-accused persons have been granted bail by this Court vide orders dated 15.10.2015, 05.01.2016, 03.05.2016, 15.03.2016 and 03.02.2017 passed in Cr. Misc. Nos. 425444 of 2015, 50869 of 2015, 12079 of 2016,

Patna High Court Cr.Misc. No.21250 of 2017 (2) dt.09-05-2017 2/2 2413 of 2016 and 46847 of 2016 respectively. Petitioner is in custody since 10.02.2017.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Jamui in connection with Laxmipur P.S. Case No. 21 of 2015.
