2. The petitioner has prayed for bail in connection with Phulwari Sharif P.S. Case No. 28 of 2025 registered for the offence punishable under Sections 310(4), 310 (5), 121(1), 109, 132, 352 and 3(5) of B.N.S. and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.

3. The case of the prosecution, in short, is that police had information that the miscreants have gathered on a white colour Bolero and they may commit some offence. On this input, the said vehicle was surrounded by the police persons. It is further alleged that the miscreants fired at the police. One Vivek Prasad received gunshot injury.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.12404 of 2026(3) dt.08-04-2026 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name is not there in the F.I.R. His name has surfaced during investigation in the self confessional statement of this petitioner. Nothing has been recovered from his possession. It has further been submitted that save and except the confessional statement of this petitioner, there is nothing against him. He is having no criminal antecedent and he is languishing in judicial custody since 14.02.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Patna in connection with Phulwari Sharif P.S.
