JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Bhabua P.S. Case No. 631 of 2016 registered under sections 324 and 307 of the Indian Penal Code.

Allegation is that the petitioner was committing theft and when the informant intervened, she was stabbed. It is submitted that both sides are agnates and living in the same house. There are several cases of civil nature pending and this informant earlier filed a rape case which was, after investigation, found false and in the present case the nature of injury is not grievous. There is no criminal antecedent against the petitioner except that such false rape case filed by the informant. Moreover the petitioner is a student of post-graduation. Having considered the said facts and circumstances, in

Patna High Court Cr.Misc. No.330 of 2017 (4) dt.10-02-2017 the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioner, namely, Pankaj Kumar Pathak @ Sonu be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabhua, Kaimur in connection with Bhabua P.S. Case No. 631 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
