This application is for grant of regular bail in connection with Mufassil P.S.Case No.12 of 2007/G.R.No.131 of 2007 for the offences under Sections 201, 364, 302, 109 and120(B) of the Indian Penal Code.

The petitioners are named in the F.I.R. There is allegation against the petitioner and other accused persons of kidnapping and murder also.

It is submitted on behalf of the petitioners that they have been falsely implicated in this case and the main allegation is against the other co-accused persons.

It is further submitted that the petitioners are in custody for about nine months.

Patna High Court Cr.Misc. No.20755 of 2017 (2) dt.09-05-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and from perusal of impugned order itself, it appears that this case is of the year, 2007, the petitioners are named in the F.I.R. and they have surrendered in the year, 2016, in the meantime trial of the other accused persons has been concluded and two persons have already been convicted in this case.

In such view of the matter, considering conduct of the petitioners, I am not inclined to grant bail to the petitioners, however, the learned trial court is directed to expedite the trial of the petitioners.

With the aforesaid observation, this application is dismissed.
