The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471/34 of the Indian Penal Code.

It is alleged that on 18.02.2008 the petitioner assured the informant to provide employment on Class-IV post in Social Welfare Department on payment of Rs. 4,000,00/-. On 02.03.2008 the petitioner demanded Rs. 50,000/- as advance and Rs. 4,000,00/- were to be paid on getting the appointment letter. Informant paid Rs. 50,000/- as advance. The petitioner came to the house of the informant on 21.09.2009, handed over the appointment letter and took Rs. 4,000,00/-. Subsequently the informant went to join, then it was found that the

Patna High Court Cr.Misc. No.13334 of 2015 (2) dt.01-04-2015 appointment letter was forged.

It is submitted by the learned counsel for the petitioner that the cause of action is of 2008-09, the First Information Report was lodged in 2014. There is no proof of payment. Statement has been made in para-3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 402 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
