The petitioner being the husband of the victim is apprehending arrest in connection with Banka P.S. Case No.649/2015 registered for the offences punishable under Sections 498a, 307/34 and of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Subsequently, section 304B IPC was also added, pending before the learned CJM, Banka. Prosecution case is of killing the daughter of the informant after one and half year of marriage for non-fulfillment of dowry demand by causing burn injuries. It is alleged in the FIR that the relationship between the petitioner and the victim was strained and the victim was taken to matrimonial house just before the incident when she was caused burn injuries.

Patna High Court Cr.Misc. No.8058 of 2016 (2) dt.18-02-2016 2/2 Considering the thrust of accusation against the husband of the victim, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
