JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mahnar P.S. Case No. 61 of 2017 instituted for the offence under Sections 341, 354(A), 506 of the Indian Penal Code and Section 8 of the POCSO Act. There is allegation in the written report that while daughter of the informant was in the school, this petitioner who was teacher in Kasturwa Gandhi residential school caught her from front side and pressed her on the wall. The girl hid herself below the desk in the class room.
It has been submitted on behalf of the petitioner that victim girl has given her statement under Section 164 Cr. P.C.
Patna High Court Cr.Misc. No.21204 of 2017 (2) dt.09-05-2017 2/2 which has been filed along with the supplementary affidavit wherein the victim has stated that no occurrence has taken place with her.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur, in connection with Mahnar P.S.
